The stage is set: 

The Central & Eastern European Development Bank provided funding for the ambitious trans-alpine motorway project in Illyria. The National Highways Agency entered into a contract with the Cetinel-Tecuci JV for the design and construction of Section C, the key 52km middle section of the highway, which included two interchanges, 5 motorway bridges, 1 railway overpass and 21 motorway culverts. The contract was based on the FIDIC 2017 Yellow Book. The Development Bank insisted on the appointment of a DAAB and made provision for the Highway Agency’s portion of the DAAB’s fees to be treated as a provisional sum.

Join experienced DRBF practitioners who will explain how that DAAB dealt with a number of the typical issues that Disputes Boards of all types have to consider. Each of the five sessions will look at a different aspect of the project, with a particular focus on dispute avoidance. Beginning with the establishment of the DAAB, to the first and subsequent site visits, informal Advisory Opinions, what happened when cracks appeared in two of the bridges, and how the DAAB dealt with a Referral hearing which took place towards the end of the project, the practical aspects and nuance of DB practice will be illuminated.
