João Mora, Conference Chair and DRBF Representative for Portugal

Founding partner of Andrade & Mora. João has over 20 years of intense national and international professional experience in the infrastructure sector, advising clients on the preparation, implementation, and legal-contractual management of relevant projects in Portugal, European markets and North Africa, Sub-Saharan Africa, Middle East and Asia. He also has extensive experience in mediation, conciliation, dispute boards, litigation, and national and international arbitrations. He has been involved in several international and cross-border transactions involving various jurisdictions, whether in the context of setting up and developing infrastructure projects and their respective financing, or in the corporate domain, notably mergers and acquisitions. João is the DRBF Representative for Portugal.

Jeremy Glover, DRBF Region 2 President 

Jeremy is a partner at Fenwick Elliott LLP , the UK’s largest construction law firm and is listed as a leader in his field in Who’s Who Legal: Construction 2020. An accredited adjudicator and member of the CIArb Adjudication Sub-Committee, he advises on all aspects of projects from initial procurement and strategic project advice to dispute avoidance and resolution. Jeremy is the co-author of Understanding the FIDIC Red and Yellow Book: A Clause by Clause Commentary, the third edition of which was published in 2018, and lead editor of Building Contract Disputes: Practice and Precedents. Jeremy is a member of the Board of Examiners on the Construction Law MSc programme at King’s College, and also teaches on the MSc Building Information Modelling Management Programme at Middlesex University. He serves as the DRBF President for Region 2.

Leo Grutters, DRBF Region 2 Past-President

Leo Grutters, BSc (civil) MBA DipArb FCIArb FDBF, is a Civil Engineer and a Dispute Resolution Expert with over 30 years of  professional experience. He holds an MBA and is a Fellow of the Chartered Institute of Arbitrators. As a Member of FIDIC's  President's List of Approved Dispute Adjudicators he has been involved as an independent neutral expert in many large  prestigious international engineering projects involving such wide-ranging sectors as roads, power generation & distribution,  off-shore, marine, renewable energies, etc. He is a forensic analyst focused on the logical and fair resolution to contractual  disputes. Due to his extensive participation in international contractual dispute resolution procedures such as Adjudication, Dispute Boards and Arbitration, he is a project-focused expert who understands the interaction between complex engineering  methodologies and the unavoidable legal and commercial implications when seen in a contractual environment. He also  regularly lectures on dispute resolution methodologies, proactive contract administration systems & procedures and he is a  regular speaker at related international events. He routinely conducts training and coaching events on the entire FIDIC  Rainbow Suite of Contracts, as well as other construction management related topics.  He is immediate Past President of the DRBF Region 2. 

 

James Perry

James (Jim) Perry is a member of the District of Columbia Bar and holds a JD degree in law and a BsCE in civil engineering and works from Paris as an arbitrator and dispute board member specialising in the construction industry. In 2003 Jim opened PS Consulting, a founding member of the Global Construction and Infrastructure Legal Alliance (GcilA). Jim has served on numerous dispute boards and ICC and DIAC Arbitration Tribunals in Central Europe, Central Asia and Latin America, Africa, SE Asia, Australasia and the Middle East and is on the FIDIC President’s list and the Syntec-Ingénierie list of adjudicators (France). Jim has also been appointed as delay and/or quantum expert witness and co-counsel on many construction arbitrations and dispute boards involving roads and bridges, dams, water management, hydro and thermal power plants, oil and gas, rail, buildings and marine infrastructure projects. Jim also provides legal and contractual support on urban renewal projects in Latin America, and industrial, hotel and leisure and other projects in France and internationally. Before founding PS Consulting Jim worked as General Manager of EuroDisneyland Imagineering and held director positions with both Employer and Contractor organisations with responsibility for contracting, and dispute resolution on projects such as Euro Disney, the Petronas Towers in Kuala Lumpur and major PPP projects in the UK and Central Europe. PS Consulting also provides several accredited training modules worldwide on FIDIC contracts. Jim is a Past-President of the Dispute Resolution Board Foundation (DRBF) Executive Board.

Rui Andrade

Rui Andrade has over 25 years of experience in the areas of Infrastructures, Construction, Litigation and Dispute Resolution, as well as arbitrator at a national and international level, in judicial and extrajudicial resolution of conflicts in the scope of international and national construction contracts, concessions, among others. After being, during more than two decades, a General Counsel in a big Latin America multinational, Rui Andrade founded Andrade & Mora in 2018. Rui Andrade advises clients on highly complex construction contracts, court and arbitration cases involving multiple jurisdictions. Rui has a huge experience in Africa (North Africa, Sub Saharan Africa including OHADA, and projects financed by the World Bank, FED, African Development Bank, Islamic Development Bank among others) and Middle East Markets.

 

Cameron Beverley

Having qualified as an English lawyer in 2003, Cameron has pursued his legal career almost entirely in Portugal over the past 17 years. Initially in private practice with Ferreira Pinto & Associados and in 2008,  following a period of secondment, he was appointed as legal counsel to the holding company of Ascendi Group with road concession businesses in Europe, central and South America as well as Africa. 

Supporting the legal team of Mota-Engil since 2012 he joined full time as legal director for Mota-Engil Engenharia e Construção, Africa, S.A. in 2015 with responsibilities and oversight on large projects, contract negotiation, dispute resolution and strategy. 

Serge Bodart

Serge Y. Bodart, Dipl. Ing. EPFL/SIA – MSc , is a Civil Engineer graduated from the Swiss Federal Institute of Technology, Lausanne (EPFL) and member of the DRBF. He holds a B.A. in Management from Webster University Geneva and a Diploma in Project Finance from HEC / University of Geneva. With more than 30 years of comprehensive technical and contractual experience, he has worked for several leading international contractors as a site manager, project manager and technical director. Since 1991, he has worked as an independent Consultant Engineer. His field of expertise covers the development and implementation of major industrial projects and PPP infrastructure projects in Europe, Africa, the Middle East, Australia and South America. Since October 2009, he also worked with PMG Consulting Engineers & Economists / Switzerland, as a Partner. He acts as a court-appointed expert in arbitration and litigation, a party-appointed expert and a dispute board member. He is also active in claims management, mediation, expert determination and adjudication for large international projects. Serge is a member of the Swiss Society of Engineers and Architects (SIA), the Expert Group of the Swiss PPP Association (PPP Swiss), the Swiss Chambers of Technical and Technical Forensic Experts (Swiss Expert), the Swiss Arbitration Association (ASA) and the Dispute Resolution Board Foundation (DRBF).

Julio Bueno

Júlio César Bueno has national and international experience focusing on the practice of construction law and engineering contracts, project finance and public procurement, as well as on arbitration and mediation proceedings, and dispute boards. He is the president of the Brazilian Society of Construction Law, and past president of Region 2 of the Dispute Resolution Board Foundation. He holds a master’s degree from the University of Cambridge (LLM, 1995) and a doctorate from the University of São Paulo Law School (PhD, 2001). He is a founder fellow of the International Academy of Construction Lawyers and officer of the Latin American & Caribbean Users’ Council for the London Court of International Arbitration.

 

António Cabaço

António Cabaço is a Research Officer at the Building Economy, Management and Technology Unit of the Buildings Department of LNEC. He has a PhD in Civil Engineering from Instituto Superior Técnico of Universidade de Lisboa on Procurement of Construction Projects and has been professional and scientifically involved in the fields of Economy in Construction, such as reference costs definition, Construction Project Management, Quality in Construction, Bids Evaluation, Energy efficiency and Construction Projects Auditing. He has participated on several technical and economical expertises and consultancy activities for public construction owners. He has also lectured at Universidade Lusófona de Humanidades e Tecnologias and Universidade Nova de Lisboa.

 

Diogo Duarte Campos

Diogo Duarte Campos is the partner who heads the Public Law practice. He has 20 years’ experience, particularly in the areas of administrative law, public contracts, public procurement and construction. His experience also includes litigation in the state courts and arbitration, both as a lawyer and as an arbitrator. Diogo also has experience in regulatory issues in multiple sectors, having worked on some of the largest construction projects, concessions, privatisations and public-private partnerships in Portugal. In recent years, he has also worked with clients in other countries, particularly Angola and Mozambique. Here, Diogo has advised on several infrastructure projects and he has experience in the construction, transport, real estate and energy sectors. He was a university lecturer for around 10 years and has a master’s in legal-economic sciences. Diogo still works regularly with higher education institutions and he is also the author of works on the areas to which he is dedicated. Diogo is on list of arbitrators of several arbitration centres, a member of the Management Committee of the Concordia - Centre for Dispute Conciliation and Mediation, and president of the Supervisory Board of the Public Markets Association (APMEP).

 

Rui Carrito

Degree in Mining Engineering and Master in Civil Engineering from University of Coimbra. Post Graduate in Management from University Católica of Lisbon. From 1984 to 1992, Engineer at Minas de Jalles, starting as an intern and reaching the position of General Director. From 1992 to 2009 at Somague Sacyr Group, directing dam works, (e.g. Alqueva Dam), tunneling works, (e.g. Tunel do Marão ) and as General Director of Transmetro, construction consortium of the 1st phase of the Porto Metro. From 2010 to 2017 at Soares da Costa in various roles as general Director in Israel, member of the Board of the Company's operations in Mozambique and General Director of the operation in Portugal. Since 2017 at Gabriel Couto, Rui is leading the international operations in Honduras, Mozambique, Zambia and Ghana.

Federico Casanova

Federico Casanova is a Master Civil Engineer with 20 years of experience. He was involved in large construction sites in Spain, Libya, Panama, Argelia and Qatar holding different positions from design manager up to project director. For the last 4 years, he is working in the Project Control Department of Sacyr Engineering and Infrastructures, holding the position of Contracts and Commercial Director.

 

Catherine Casau-Dougnac

Catherine Casau-Dougnac has a French and Spanish Master's degree in Law. After more than 10 years working for the Vinci group as Legal Counsel and Contract Manager in France and abroad (Chile and Hungary), she joined the Société du Grand Paris five years ago. She is responsible for the Contract Management of one of the four lines of the new metro.

Yasemin Cetinel

Yasemin Çetinel is an attorney at law specialized in international investment and commercial arbitration, with a specific focus on settlement of construction disputes. She holds a postgraduate degree in international commercial arbitration from the Queen Mary and Westfield College, University of London. She has been involved in numerous ICSID arbitrations, including representation of Turkish contractors against the Republic of Kyrgyzstan, the Hashemite Kingdom of Jordan, the Republic of Georgia, the Republic of Yemen (current mandate) and the Republic of Turkmenistan (current mandate). She has represented contractors of various nationalities against state entities and private entities of states including the Republic of Yemen, Romania and the Russian Federation and the Republic of Azerbaijan (current mandate), at settlement of commercial arbitration disputes. She is the founding partner of Cetinel Law Firm, in Istanbul, Turkey, currently advising Turkish contractors on the disputes arisen out of the unrest in Libya, besides representing clients in several dispute settlement proceedings. She has an extensive experience at execution of FIDIC based contracts concluded with Turkish state entities as well as with the Bolivarian Republic of Venezuela and Iran. Her fields of expertise also include providing consultancy to and representation of international companies at public tenders in the Republic of Turkey. Yasemin serves as the DRBF Representative for Turkey and member of the DRBF Region 2 Board.

 

Jean-Marc Coulon

Legal Director at Bouygues Construction. After a first career stretch within the Bouygues group in the holding legal department, Jean-Marc Coulon has gained experience for almost 20 years in different positions as lawyer within the construction division of the group. He focused first on non-contentious legal work, including in particular project finance legal work, being involved on projects overseas and in the French domestic market. Thereafter, whilst based in London for six years, he worked on projects in the UK domestic market. Back in France, leading the legal

department of the infrastructure/civil engineering business of Bouygues Construction for six years now, he also focuses on contentious legal work and as such took part in several disputes related to infrastructure projects throughout the world involving alternative dispute resolution processes.

Christian Diaz

Christian Díaz Barcia, Mediator, Adjudicator and Arbitrator, is partner at LPA Legal & Consulting Costa Rica and Director of the International Arbitration Practice. He has an LLM in Corporate Law at the Universidad para la Cooperación Internacional (UCI) Costa Rica, a Postgraduate Diploma in International Commercial Arbitration at Queen Mary London University, and is alumni of the ICC Latin America Arbitration Academy. Christian has training in FIDIC Contract Models and Dispute Boards. For 10 years was Arbitral Secretary at the Dispute Resolution Centre at the Costa Rica Chamber of Engineers and Architects. He is a mediator, arbitrator and Dispute Boards member. In Costa Rica, he is arbitrator at CICA, CCA, CRC-CFIA y CNDR-FEDEFUTBOL, in CARC-PUCP (Perú), CESCON (Panamá) and CeCAP (Panamá). He is a Dispute Board member at CMA (El Salvador); of counsel consultant at IDB Costa Rica; and Country Representative for Costa Rica of the Dispute Resolution Board Foundation. Christian also serves as the President of the Board of Directors of the Asociación Latinoamericana de Derecho de Construcción, ALDEC.

Giovanni Di Folco

Giovanni Di Folco is the President, co-owner and Senior Partner of Techno Engineering & Associates Group, an international techno-legal Consulting Engineering Firm specializing in Integrated Contract Management, Claims and Dispute Avoidance & Resolution internationally, with experience in representing clients in international Adjudication, Arbitration and Litigation. He is a Civil Engineer, Arbitrator, Adjudicator, Expert Witness in Delay and Quantum and a legal arbitration practitioner with more than 30 years’ experience of managing multi-disciplinary civil engineering projects around the world, including Italy, Iran, Libya, South Africa, the Kingdom of Lesotho, Ethiopia, Kenya, the Sultanate of Oman, the United Arab Emirates, Qatar, Kuwait, Greece, Turkey, Sweden, Norway, Albania, Armenia, Bulgaria, Moldova, Serbia, Georgia, Kazakhstan, Tajikistan, Indonesia, Latin America, India, North America, Vietnam, Indonesia and Romania.

Mr Di Folco is a past Director and the current President-Elect of the DRBF Region 2 Board of Directors and is listed on the prestigious FIDIC President List of Certified Adjudicators. He is also a FIDIC Accredited Trainer, a FIDIC Certified Adjudicator and an Expert in project & contract management, contract administration, claims preparation and defense, delay analysis and quantum ascertainment.  He has gained extensive experience in both international arbitration and adjudication work whilst acting as Arbitrator, Adjudicator, DB, DAB, DAAB and Counsel for a wide variety of clients. In particular, he has represented international clients and been involved in more than one hundred thirty international dispute adjudication procedures and in more than 60 international arbitrations conducted under the ICC and UNCITRAL Rules relating to disputes under the FIDIC Red, Yellow, Pink and Silver Books conditions of contract. Mr Di Folco is a Claims Expert, and he trains regularly internationally on FIDIC and the workings of Dispute Boards. Mr Di Folco lectures at various universities, is a Visiting Professor at the Politecnico of Milano University and is a regular guest speaker at several international conferences, seminars and workshops. He is the Vice President of the Romanian Association of Consulting Engineers (ARIC) and a Director of the Italian Chamber of Commerce for Romania. He has authored and published, books and many papers and articles over the years regarding civil engineering, dispute boards, adjudication, arbitration, procurement, claims and contract management matters.

Simon Fegen

Simon Fegen is Operations Director at Leach Group, in Bath, United Kingdom. He joined the Leach Group in 2008 and specialises in the preparation and negotiation of contractual claims for Leach’s global Contractor and Subcontractor clients. Simon also prepares and conducts training courses on dispute avoidance and contract administration. He specializes in Dispute Avoidance by promoting the practice of sound contract administration, and in Dispute Resolution with negotiation and mediation. Where required, he offers his experience with the preparation of claims and defence of claims to Dispute Boards and Arbitration. Professional experience spans a variety of projects, including power stations, water treatment plants, water pipelines, roads, and airport terminal buildings, in various locations in Africa, Asia and Europe. Mr. Fegen is a Chartered Surveyor (Royal Institution of Chartered Surveyors), Fellow of the Association of Arbitrators (Southern Africa), and a CEDR Accredited Mediator. Today, he serves as Director of Training for the Dispute Resolution Board Foundation (DRBF) Region 2.

Ron Finlay

Ronald A (Ron) Finlay, AM, is Past President of the DRBF Executive Board. In his professional life, Ron is an infrastructure specialist and the chief executive of his own consulting business, Finlay Consulting, and a sole practitioner trading as R.A. Finlay, Lawyer. He has over 40 years’ experience in property, construction, development and infrastructure projects. This includes a number of significant roles as project manager, lead negotiator or facilitator of major infrastructure projects in Australia and overseas for both public and private sector organisations. In 2003, Ron was one of the founders of the DRBF Chapter now known as Region 3. He has been the Secretary and Executive Board member of Region 3 since 2003, has been an active promoter of the use of Dispute Boards in Australasia and has served on over 16 Dispute Boards (most as chair). In 2014 he received the DRBF Al Mathews Award. Further, in 2015 he received membership of the Order of Australia for services to law in relation to the infrastructure industry and dispute avoidance and resolution.

 

Steven Goldstein

Steve Goldstein was admitted as a Barrister in 1993 and specialises in building and construction matters. Steve is heavily involved in all forms of alternative dispute resolution including as arbitrator, mediator, facilitator, expert determiner and Dispute Avoidance Board member. Steve has been appointed as a Dispute Board Member on more than 15 occasions. He has also acted as a Supreme Court Referee, District Court referee and Local Court arbitrator. Steve is President-Elect of the DRBF and was formerly President of Region 3. Steve is a fellow of the Resolution Institute and held the position of NSW Chapter Chair for 4 years. Steve holds a bachelor’s degree in civil engineering and is a Chartered Professional Engineer and Member of Engineers Australia. Steve practised as a civil engineer in the construction industry for 17 years prior to being called to the Bar.

 

Eng. Luis Gomes Rodrigues

Luis G. Rodrigues is a civil engineer and is Senior Partner and Member of the Board IGC – Investimento Gestão e Consultoria, Lda. In Portugal. He is an Arbitrator (Member / Chairman), Expert Witness, and serves as Member/Chair of Dispute Boards (DAB/DB/CRdC). His technical experience includes Hydroelectric and Hydraulic projects, Railway projects; Highway and Road projects; Bridges and Viaducts projects; Tunnels, Shafts and Underground projects; Industrial and other buildings; Infrastructure projects; Marine Civil Engineering projects; Waste Treatment and Pumping Stations. He is a senior member of  Ordem dos Engenheiros (Nr. 14427) of Portugal, and a member of Sociedade Portuguesa de Geotecnia and the Dispute Resolution Board Foundation.

 

Manuel Luís Gonçalves

Manuel Luís Gonçalves is graduated from the Law School of the University of Porto and postgraduate in Urbanism Law, Real Estate Law and Administrative Litigation, from this Law School and from Universidade Católica Portuguesa. He is a lawyer, Head of Legal of Casais Group and member of the CNA - National Center for Construction Arbitration, having been awarded in 2018 with the international Iberian Lawyer Gold Awards in the category International Team - Focus Africa.

Nicholas Gould

Nicholas Gould, BSc (Hons), LL.M., FRICS, FCIArb, MCIOB, is President of the Executive Board of the Dispute Resolution Board Foundation and a partner in the specialist construction, engineering and energy lawyers Fenwick Elliott LLP, where he conducts a mix of international dispute resolution and non-contentious work. He is a solicitor-advocate, chartered surveyor, accredited adjudicator and CEDR Chambers lead mediator. He acts for contractors, employers and governments in the building, construction, engineering, infrastructure, transport, energy, oil and gas, and process engineering sectors. Dispute resolution experience spans litigation, arbitration (domestic and international), adjudication, DAB/DRB, mediation, early neutral evaluation and expert determination. He regularly acts as lead mediator in multi-party multi- million disputes. Nicholas is a certified adjudicator and sits on international dispute boards and as arbitrator. Chamber & Partners 2011 notes Nicholas for his “ability to pre-empt potential problems and provide advice in a clear manner that maintains the individual needs of clients”. Legal 500, 2011 edition list Nicholas as a leading figure for Construction and Mediation who is “extremely knowledgeable and listens carefully to his clients”. The IBA’s 2008 and 2013 editions of International Who’s Who of Business Lawyers Today listed Nicholas as one of the “ten most highly regarded individuals internationally for construction law” and the IBA’s Who’s Who Legal 2015 listed Nicholas in the top five in Europe.

Andrew Griffiths

Andrew (Andy) Griffiths is an independent dispute resolution practitioner based in Johannesburg, South Africa. A civil engineer by profession, Andy also holds a Higher Diploma in Arbitration (Specialising in construction law). He is a Member of the FIDIC President’s List of Approved Dispute Adjudicators, as well as the SAICE and CESA President’s List of Arbitrators, Mediators and Adjudicators, and the ICE-SA Panel of NEC Adjudicators. Andy has acted in over 70 disputes involving Dispute Boards, either as a DB member or as the Engineer, and has also acted as Adjudicator, Mediator or Arbitrator on over 50 other disputes. In his near 40-year engineering career, Andy was intimately involved in the design, planning and project management of some of Southern Africa's largest projects, such as the Mokolo-Crocodile Water Augmentation Project, the Berg River Dam and Pipeline, the 110km VRESAP pipeline, Durban Harbour Tunnel, and the Lesotho Highlands Water Project : the 185 metre high Katse Dam, the 45km Transfer Tunnel, the 32km Mohale Tunnel, and the Matsoku Weir and Tunnel. He is a Registered Professional Engineer (RSA), a Chartered Engineer (UK), a Fellow of the South African Institute of Civil Engineers, a Fellow of the Institution of Civil Engineers (UK), and a Fellow of the Association of Arbitrators (Southern Africa). He is immediate Past-President of the Dispute Resolution Board Foundation (DRBF) Executive Board.

Pablo Laorden

Pablo Laorden is the managing partner of Lámbal Abogados, a Spanish law firm and consultancy specialised in the engineering and construction industry. He holds a Master Degree in Construction Law from the Madrid’s Polytechnic University, is a Fellow of the Chartered Institute of Arbitrators (FCIArb), member of the Society of Construction Law (UK), and is listed as Arbitrator in various institutions including the Madrid Court of Arbitration of the Madrid Chamber of Commerce. He is the Country Representative for Spain in the Dispute Resolution Board Foundation (DRBF) and is a trainer for the association. Pablo Laorden coordinated the Spanish translation of the FIDIC Books (1999 Edition), and speaks regularly on seminars about Construction Contracts (including FIDIC Contracts) Dispute Resolution and Arbitration. He is an Accredited Trainer recognised by FIDIC and is currently providing FIDIC training around Latin America. Mr. Laorden provides legal and contractual advice to the engineering and construction industry, drafting and negotiating contractual documents, advising during the construction process, and assisting and representing in claims and dispute resolution including Dispute Boards, ADR, litigation and arbitration.

Enzo de Laurentiis  

Enzo de Laurentiis is the Chief Procurement officer in the Operations Policy and Country Services Vice-Presidency of the World Bank. Previously, he served as Manager of the Procurement Policy Unit in the same Vice-Presidency, as a Practice Manager in the Governance Global Practice, and as the Regional Procurement Manager for the East Asia and Pacific and the Latin America and Caribbean Regions of the World Bank. Prior to joining the World Bank as Procurement Specialist in 1998, de Laurentiis was Projects Director and later Vice President of an international consulting firm providing advisory services on procurement to Multilateral Development Banks, countries and the private sector. He has been a member of the adjunct faculty at American University Washington College of Law in Washington, D.C., from 1992 to 2004, teaching international contracts and international procurement law. He has also prior legal and international banking experience. De Laurentiis holds a law degree (Dottore in Giurisprudenza) from the University of Trieste in Italy and a Masters of Laws (LL.M.) in International Legal Studies from American University Washington College of Law.  

Vincent Leloup 

Vincent Leloup (FCIArb, FDBF, DRBF, MSc.) is the Chairman of the FIDIC Contracts Committee, a FIDIC International Accredited Trainer and an Accredited Adjudicator. He delivers training, consulting (contract procurement strategy, contract drafting, risk analysis and contract management) and dispute resolution services (mediator, dispute board member, expert witness, arbitrator) for the construction industry. Vincent is a professional engineer by trade (MSc Water Management, MSc Agronomy, EUR ING), with legal qualifications (MSc Construction Law and Dispute Resolution, King’s College, London), and comes from a Contractor then consulting engineering background with 25 years of experience on international building and infrastructure projects across Asia, Africa, Europe and Central America, with a particular expertise on water supply & wastewater infrastructure projects.  Vincent is one of the drafters of the FIDIC 2017 Suite of Agreements, and is the principal drafter of the update of the FIDIC 1999 Green Book which will be published by FIDIC in the near future. He is also the Founder and Director of Studies of the Postgraduate Diploma International Construction Contracts (I2C), delivered by Paris Pantheon-Assas University.

 

João Loureiro

João Loureiro is a civil engineer graduated from Instituto Superior Técnico in 1985 and Post-graduated from Católica Lisbon School of Business and Economics  and AESE Business School. From 1991 to 2016, he has acted as Production Director and Member of the Board of Directors of Ferrovias (Mota-Engil Group), main player in the railway sector.  He has comprehensive technical and management experience in major Railway projects, in Portugal and in international markets like Spain, Hungary, Turkey, Algeria, Mozambique and Malawi. Since 2016, as managing partner of Image4All, he has been involved in the energy sector, efficiency projects and photovoltaic solar systems. He is also acting as consultant in significant railway projects currently under construction in Portugal, and has experience as technical expert in the context of Arbitral Tribunals. He is a senior member of the National Engineer Bar of Portugal and is also a member of the Dispute Resolution Board Foundation.

 

Eng. Luis de Carvalho Machado

After graduating from Instituto Superior Técnico in 1974, he joined the Board of Bridge Services of the Junta Autónoma de Estradas as a Civil Engineer, having transferred in 1991 to BRISA, where, as Vice-Chairman of the Board of Directors, was responsible for the entire construction process of the highway network of the highway concessionaire. In parallel, between 1993 and 1998, he was also responsible for the studies that allowed the award of the Nova Travessia do Tejo concession in Lisbon and, under his coordination, the Vasco da Gama Bridge was built. In 2001, he took over as chairman of the Board of Directors of the Águas de Portugal Group, with the aim of promoting the completion of the coverage of drinking water supply, sanitation and solid urban waste collection in the national territory.

 

At Caixa Geral de Depósitos, since 2004 and until 2018, he was responsible for the administration of real estate funds and, at the National Engineer Bar, has maintained constant collaboration, acting as coordinator of the Specialization in Construction Direction and Management, as President of the National College of Civil Engineering and currently President of the South Region.

 

With post-graduate degrees in management, throughout his professional life he has always been involved in consultancy work in large civil engineering works and has been a member of numerous Arbitral Tribunals and Expertise’s in major public and private infrastructures.

 

 

Mário Menezes

Mário Jorge Menezes: Lawyer in Cape Verde and in Portugal, founder of the law firm / office “MLA Advogados”. Started his activity in Portugal in 1993 and also in Cabo Verde since 2006. Head of the Team of Consultants who prepared the “Diagnosis on Public Procurement and Administrative Contracts Legislation” in Cabo Verde (2020/2021). Participated in the negotiation and execution of a wide range of international contracts, public and private, including contracts based on the FIDIC suite of contracts.

 

Mark Moseley

Mark M. Moseley is the Principal of Moseley Infrastructure Advisory Services (MMM Infra), a global individual consulting firm advising on infrastructure projects and enabling environments, for multilateral development banks, governments and private sector entities. Mark has over 40 years of international infrastructure experience, having held the following positions as Chief Operating Officer of the Global Infrastructure Hub (GI Hub), an initiative of the G20; Lead Counsel, Infrastructure Practice Group, The World Bank; Partner and Practice Group Manager for the Global Energy, Projects and Construction Group at the international law firm CMS Cameron McKenna; and Lecturer on Legal Issues for Public-Private Partnership Infrastructure Transactions at the Harvard Kennedy School.

Henry M. Musonda

Henry Musonda, FCIArb, is a Civil/Structural Engineer an Arbitrator, Adjudicator and Mediator. He is a Fellow of the Chartered Institute of Arbitrators (UK), and the listed on the FIDIC and DRBF Presidents’ lists of Adjudicators. He has more than 35 years of practical and professional experience in the design, administration and project management of building and civil works and service contracts and providing advisory support on infrastructure projects to FIDIC and various forms of contract. He has international experience as an Arbitrator and Adjudicator and has strong knowledge and background of Application of alternative dispute resolution methods and Dispute Boards to infrastructure projects. He is a FIDIC listed trainer and has conducted training in Tanzania, South Africa, Uganda, Zambia and Zimbabwe. He serves also as the DRBF’s Representative to Zambia.

Aisha Nadar

For over 30 years, Aisha Nadar has been actively involved in all phases of the negotiation and implementation of large-scale cross-border infrastructure and defence programs. Her procurement and international contract management experience includes holding senior level positions in the US, the Middle East and Europe. She regularly advises clients on strategic procurement planning, contract drafting, contract management and dispute resolution and acts as arbitrator, mediator and dispute board member and has experience of ICC, LCIA, SCC, DIAC, AAA, UNCITRAL and FIDIC rules. Aisha has carried out assignments related to dispute resolution for organizations such as the World Bank, USAID and US DoD and is a regularly invited speaker at universities and specialized conferences on construction contracts and dispute resolution. Aisha is a member of FIDIC’s Executive Committee, the Chair of FIDIC’s Procurement Policy Sub-Committee, is listed on FIDIC President’s List of Accredited Adjudicators and served as one of the principal drafters of the updates of the FIDIC 1999 Suite. She is an officer of the International Construction Projects Committee of the International Bar Association and has previously served as a member of the Standing Committee of ICC International Centre for ADR. Aisha holds a BS Electrical Engineering from University of Nebraska, an MBA from University of Texas-Austin and an LL.M. in International Commercial Dispute Resolution from Queen Mary, University of London and completed the CIArb Diploma Course in International Commercial Arbitration, Oxford in 2005.

 

Matthias Neuenschwander

Matthias Neuenschwander is a M.Sc. in Civil Engineering from ETH Zurich, Switzerland, a certified commercial mediator and a member of the DRBF. He has over 35 years worldwide experience as a contractor, designer, supervisor, engineer, DRB member and arbitrator. For fifteen years, Matthias participated in the construction of the Gotthard Base Tunnel in leading positions, and was a Managing Director with Lombardi Consulting Engineers before founding his own firm, specialising in advisory on procurement, contracting and dispute avoidance and resolution for large infrastructure projects. He chaired the FIDIC-ITA joint task group that drafted the Emerald Book and is the animateur of the ITA Working Group 3 “Contractual Practices”.

 

Bartolomeu Noronha

Bartolomeu de Noronha has national and international experience focusing on the practice of construction law and engineering contracts, project finance and public procurement, as well as on arbitration and mediation proceedings.

Bartolomeu de Noronha is theExecutive Director of the National Arbitration Centre for Construction, Director of the Arbitration Centre of the Portuguese Association of Public Markets and President of the Scientific Council of the Association Observatory of Municipalities.

Toshihiko Omoto

Professor Dr. Toshihiko Omoto , Dr(Eng) MSc/BSc (Civil Eng) MSc (Const Law & Arb), PE, FJSCE, FICE, FCIArb, and AAA/SIAC/VIAC/KLRCA Panelist. Professor Omoto has 40 years’ experience in the construction industry, including 35 years experience on international projects in some 25 countries. His experiences as Neutral include Dispute Board member, arbitrator and mediator. He is an Adjunct Professor on Contract Management and Dispute Resolution at the Graduate School of Management of Kyoto University (MBA), Japan. He received the Al Mathews Award for Dispute Board Excellence from the DRBF in 2012.

 

Ignacio Palacios

Ignacio Palacios holds a BSc (hons), MRICS, MCIArb and is a member of the DRBF Region 2 Board of Directors. He has extensive experience in the construction industry after being involved in multimillion-dollar projects in Asia, Europe, Australia and Latin America. He currently works as a Regional Director for Quantum Global Solutions a large, global and independent claims consultancy.

Patrizia Palmitessa-Savric

Patrizia Palmitessa-Savric holds a Master of Architecture from University of Belgrade and a Master of Science in Construction Law and Dispute Resolution from King’s College London. She is Head of Contracts and Dispute Resolution at Ginder Palmitessa (PTY) LTD and is based in Gaborone, Botswana since 1995. Patrizia is a FIDIC International Accredited Trainer and was a friendly reviewer of the FIDIC Second Edition Red, Yellow and Silver books. She acts as arbitrator, adjudicator and dispute board member and has been involved in avoidance and resolution of construction disputes on projects in Botswana, South Africa, Mozambique and Tanzania. Patrizia has been a member of the DRBF since 2008 and now serves on the DRBF Region 2 Board of Directors.

 

Kiri Parr

Kiri Parr’s technical background is as a specialist construction lawyer, with 10 years in private legal practice and 15 years as general counsel for a large international professional consulting company. Her experience extends across a range of major projects delivered in the Australian market over the last two decades, from project conception to the litigation fall out. In recent years, Kiri has extended her involvement across the construction industry as: board member of Consult Australia from 2013 to 2019 with the last two years as Chair; Senior Fellow at the University of Melbourne, co-delivering the course Major Project Delivery: The Legal Interfaces as part of the Masters of Construction Law program; and most recently, an appointment to the FIDIC Contracts Committee (CO Vice-Chair). She is a member of the Dispute Resolution Board Foundation.

Marcela Radovic

Marcela Radovic is an attorney with more than 18 years of experience in contractual and claim management in construction industry in Chile and other countries in Latin America, focusing mainly in the mining, energy, retail and public infrastructure sectors. She is Founder and Director of Chilean Society of Construction Law and has earned a master’s degree in Regulation at London School of Economics University. Marcela is also a Professional Coach and Candidate for a Master's Degree in Coaching and Leadership from Barcelona University. Concerning her teaching experience, Marcela is Professor of “Magister de la Construcción” of the Engineer Faculty of Pontificia Universidad Católica de Chile, Professor of Universidad de Los Andes in Construction Law and Professor of Universidad de Talca in Construction Law. She has been a member of Dispute Resolution Board Foundation since 2009 and serves as the DRBF's Representative for Chile. She has also been a member of International Bar Association since 2014.

 

Marianne Ramey 

Marianne Ramey is the founder and President of Project Advisors International, an independent construction consultancy delivering expert forensic and proactive programming services on large and complex projects located worldwide. She manages offices in the US and UAE and provides expert testimony on the cause and effect of delay on project delivery. She has extensive experience resolving complex time related dispute issues using advanced analysis techniques. She has testified numerous times before arbitral tribunals and dispute boards. Marianne is a Civil Engineer in the US and Australia, certified Project Management Professional, founding member of Society of Construction Law North America and its International Liaison Officer, contributing author to the Delay and Disruption Protocol, 2nd Edition, and former Director with the DRBF.

 

Pedro Rodrigues

Civil Engineer, since 1995, MsC in Construction Management with more than 25 years of professional activity in Project Management and Construction Supervision, involved in the life cycle of projects in public and private sectors. Contract Manager with knowledge of European and Portuguese public procurement legislation, worked abroad as project director in Macau, Brazil, East Europe and Turkey. Lecturer of several courses in Portuguese Public Procurement Law, FIDIC, Contract Management and Construction and Supervision Management, at IST – Instituto Superior Técnico, FUNDEC – Association for Training and Development in Civil Engineering and Architecture and CEEC – Instituto Superior de Engenharia de Lisboa – ISEL.

 

Ann Russo

Ann Russo is Executive Director of the Dispute Resolution Board Foundation, the non-profit association dedicated to the use of Dispute Review Boards worldwide. She is co-editor of the Dispute Board Manual: A Guide to Best Practices and Procedures. Prior to joining the DRBF, she served as Public Relations Manager for J.A. Jones, Inc., an international construction and engineering firm based in Charlotte, NC, USA. She received the DRBF's President’s Distinguished Service Award in 2005.

 

Luis Melo de Sampaio

Civil Engineer, worked internationally for more than 25 years in large scale projects as Project Director, Country Manager and Contractor’s Representative. Participated in several technical expertises, arbitrations and consulting works, as well as Contractor’s Representative in DABs. A true believer in Dispute Avoidance. DRBF member since 2019.

Evgeny Smirnov

Evgeny Smirnov, a Russian national, is an associate director, policy advisor, working at the EBRD Procurement Policy and Advisory Department. He coordinates the policy dialogue with the governments of the Bank's countries of operation in respect of public procurement. He also provides policy and specific project implementation and risk management advice to the Bank's operational teams and clients across all sectors and countries of the Bank’s operations. He is a member of EBRD-UNICTRAL Taskforce, OECD/DAC MAPS Working group as well as OECD/ACN monitoring teams for selected countries. He was a reviewer of the Second Edition of FIDIC standard forms of contract. Evgeny reads lectures on contract management, procurement and construction law at Rome University Tor Vergata, University of Stuttgart and European Academy for Taxes, Economic and Law in Berlin. After joining the Bank in 2000, for ten years he worked at the Infrastructure Business Group on numerous projects in many of the Bank's countries of operation, being responsible for developing project delivery strategies, advising and assisting clients during projects implementation on the associated risk management issues. Prior to joining EBRD, Evgeny was a procurement consultant on a number of World Bank funded projects in Russia in different sectors, including transport, environmental protection, agriculture and health sector, working closely with different Federal Ministries and Agencies of the Russian Federation. Before that, since 1993 for four years Evgeny worked at the Ministry of Foreign Economic Affairs of Russia on large construction and irrigation projects in the Middle East and Africa. He possesses a Master Degree (with honors) in water sector management and environmental engineering by Moscow State University of Environmental Engineering. He also holds a diploma in government procurement management by National Research University Higher School of Economics, Moscow.

Patricia Sulser

Patricia Sulser has been an emerging markets professional for 35+ years, including 11 years as Global Lead and Chief Counsel and on the Investment Committee of an innovative infrastructure venture capital style fund at International Finance Corporation (IFC)—IFC InfraVentures.  She has worked on projects in over 50 countries on 5 continents and is committed to international development and particularly to public private partnerships.  The many PPP projects on which she has worked involved extensive negotiations among executives and senior officials of governments, private companies, contractor as well as PPP beneficiaries and other stakeholders.   A number of these projects encountered unanticipated disruptions and disputes among contractors and owners, governments, and among shareholders.  Creative alternative dispute resolution tools and flexibility on the part of all stakeholders have been critical to keeping these projects on track to deliver measurable developmental impact. Ms. Sulser is a certified Arbitrator, Mediator and Dispute Board Member.

Elizabeth Tippin

Elizabeth A. Tippin, Esq., FCIArb, LEED AP, is President of the DRBF Region 1. She is an arbitrator, mediator, Dispute Board member and consultant based in San Francisco, California, USA. Formerly an Administrative Law Judge specialized in construction, her experience also includes providing consulting legal services for owners, design professionals and construction firms, including contract preparation for domestic and international projects, risk management, sustainability and representation on disputed matters. She has experience with projects encompassing commercial buildings, fire stations, airports, schools, water treatment plants, tunneling and micro-tunneling projects, energy, highway and bridge construction, using all project delivery methods including Design/Build and P3 Project Delivery. She is an Adjunct Professor teaching Professional Practice in the Architecture Department at Academy of Art University. She is an Accredited Professional for the Leadership in Energy and Environmental Design (LEED AP). She is a member of the Commercial and Construction Panels of American Arbitration Association, Contractors State Licensing Board, Caltrans DRB and Partnering Panels. She is a Fellow of the Chartered Institute of Arbitrators and has completed training for FIDIC Dispute Boards.

 

Gonçalo Diniz Vieira

Gonçalo Diniz Vieira is a Portuguese civil engineer specialised in tunnelling and complex geotechnical projects with more than 20 years of experience as consultant, designer and manager of public works. Master of Sciences in Soil Mechanics and Geotechnical Engineering (2008), Gonçalo’s thesis was awarded with the 1st prize of Portuguese Geotechnical Society for Master Thesis in the biennium 2007-2008. He post-graduated in public procurement (2013) with a final work entitled “New framework of additional works to public contracts in complex geotechnical works, with special reference to tunnel construction and to the Portuguese Public Contracts Code”. He also studied Business Administration and concluded the MBA in 2015. Gonçalo is very interested in multiple problem solving, creating synergies between engineering management and procurement; He is the founder and animateur of the new workgroup GT2 “Engineering & Law: Contractual Practices” of the Portuguese Tunnel Committee, and a member of the Portuguese Engineering Association, the Portuguese Geotechnical Society and board of the Portuguese Tunnel Committee. He represents Portugal in the International Tunnelling Association (as WG3 member), which recently published the “ITA Recommendations on Contractual Framework Checklist for Subsurface Construction Contracts” - 2nd edition 2020 – ITA REPORT #25. He was also a friendly reviewer of FIDIC publication New Emerald Book “New Form of Contract for Tunnelling and Underground Works” (2018). Gonçalo published more than 20 papers in national and international conferences and seminars, and he was awarded with 1st prime SPG for young geotechnical articles in Portuguese language “Tunnels from Lisbon Metro – Red Line: Troço 98º. Design and technical assistance of works” (2010). Gonçalo is currently working as a senior manager & Tunnel specialist at Lisbon Municipality, launching and managing a public tender Lisbon Drainage Master Plan (the biggest @ Lisbon, 140M€) for two tunnels and important adjacent infrastructures to solve storm drainage and flood problems (in progress).
